LAWYER STARTS CASE TO BLOCK EXTENSION TO ARTICLE 50 NOTICE.

PRESS RELEASE

Robin Tilbrook, the Chairman of the English Democrats and a Solicitor, has started a case to block the UK Government from extending the Article 50 Notice or revoking it without having to get an Act of Parliament. 

The Civil Procedure Rules protocol letter which Robin has sent to the Government is set out below.  The Government had 21 days to respond, which means that the Court will be likely to rule that any attempt to extend was illegal and invalid after the 29th March and therefore when the UK will have already constitutionally left the EU.  The letter is attached. 

Robin Tilbrook said:-  “I am seeking funding to raise the necessary money to bring this case, which is of vital importance to all those of us who want to see a proper full Brexit implemented, to give full effect to the Will of the English People, expressed in a nearly two million vote majority in the 2016 referendum.”

“The constitutional law set out in the Gina Millar case is, in my legal opinion, clear and unchallengeable that any attempt to extend the Article 50 Notice or to revoke it without a specific Act of Parliament will be invalid and unlawful.  That would mean that if there has been a purported attempt to extend the Notice by agreement without an Act of Parliament that that would be invalid and therefore we would be out of the EU regardless of what the Government said we were.” 

Robin continued:- “For once this is an opportunity to make history through the courts which I hope will attract enough support to make bringing the case financially viable.”

Letter Before Claim 

This letter is drafted under the judicial review protocol in section C of the White Book, which provides for a response within 14 days. Given the urgency of the matter, we would appreciate a response within 7 to 14 days.

1.    Respondent: Our clients provisionally identify three possible defendants: the Prime Minister (or, if necessary, the First Lord of the Treasury), as the person with overall responsibility for Brexit policy; the Minister for the Cabinet Office and Chancellor of the Duchy of Lancaster; and the Secretary of State for Exiting the European Union.

2.    Applicant: Mr R C W Tilbrook for the English Democrats of Quires Green, Willingale, Ongar, Essex, CM5 0QP, and for and on behalf of the 15,188,406 voters in England who voted to Leave the European Union in the 2016 referendum.

3.    The details of the Applicant’s legal advisers, if any, dealing with this claim:-

4.    The details of the matters being challenged:-

Any purported non-statutory Extension or Revocation of the United Kingdom’s notification to Leave the European Union given under Article 50 of the Lisbon Treaty.

Every person in England and in particular the 15,188,406 voters in England who voted to Leave the European Union in the 2016 referendum.
6.    The Issues:-

Following the Judgments of the High Court, of the Court of Appeal and of the Supreme Court in R (on the application of Miller and another) – v – Secretary of State for Exiting the European Union [2017] UKSC5 and the consequent enactment of the European Union (Notification of Withdrawal) Act 2017, there is no remaining discretionary prerogative power vested in Her Majesty’s Government to agree any extension to the Article 50 Notice, or to Revoke the said Notice without a further express Act of Parliament to authorise such Extension or Revocation. 

Accordingly any purported Extension or Revocation is void and of no effect. 

7.    The details of the action that the Defendant is required to take:-

What is sought from the Respondents is:

(i)             An undertaking that there will be no attempt to purport to vary the Notice given under the said EU Withdrawal Act except pursuant to an express Act of Parliament; and
(ii)           A formal admission that the Government admits that any such purported extension of the notice period or revocation would be legally invalid; and
(iii)         A formal admission that, in the absence of any further statute, the UK’s departure from the European Union shall go ahead as notified; vis: on the 29th March 2019.

    4. The vote to take 'no deal' off the table. This will need to be reinforced by an Act of Parliament, which Diane Dodds MEP (wife of N. Dodds MP, DUP) said can be achieved by an accelerated procedure in 24 hours.

      I hope this is wrong or can be stopped.

      The corrupt few in parliament have hap put themselves in opposition of the majority who voted Brexit, against the democratic mandate for Brexit W.T.O and against democracy itself.

  9. Dear Parliamentary candidate, we understand you wish to apply as Member of Parliament for the Constituency of Chalk & Cheese.

    Please understand because of the duplicity and lying by the previous member of Parliament we have changed the rules.

    To Explain:

    1. There are approximately 70,000 voters in most of UK's constituency's, when an election is called each voter gets "Nominally" £3 each, to vote towards the wages of their chosen candidate, currently, most constituencies candidates win their seat with a 20-23,000 majority, ALL Parties are required to nominate both a Male & female candidates.

    2. You, may not know this but ALL MP's when elected form themselves into limited liability Companies, under the new rules the Chair of the local party is appointed as the CEO of the company and the MP's are paid employees as COO of the company, the company expenses are audited and published as any normal company. showing expenses, entitlements and earnings as a matter of public record.

    The BIG BUT is, the more voters you work hard for and increase your support then increase your wages. (Like) also, you may be able to actively measure the level of your support.

    This is a contract where you the CANDIDATE agrees to work for the electorate.

    1. The 15,188,406 voters are from England, the other 2,211,594 voters are from other parts of the UK, i.e. Scotland, Wales, Northern Ireland.

    3. As I understand it, other laws and legal systems apply in the rest of the UK. Simpler to only go to court in one country on behalf of that countries citizens (the one in which Mr Tilbrook practices) and I don't think it will make make any practical difference to the outcome, one way or the other.

  20. This is a wonderful thing to behold because we all know how we are being duped by the PM and her government. I sincerely hope it procures a positive result because we cannot spare any more time for delays. I am wondering where the funding comes from for this? However, one mention... the Brexit leavers votes amounted to 17,410,742 so I hope this doesn't have a negative affect on a positive result of this action.

  21. Party policy or not, the British public voted to leave the EU, not for any deals that May subsequently added, changed and added again, seemingly ad infinitum. These MPs are supposed to be our representatives to whom we pay large salaries and exorbitant expenses. For the past 40+ years they've been paid for having a kip in parliament except when it comes to a salary rise when the houses are mobbed. I'd like to know when they are going to do what we are paying them to do. They need to stop polishing their shiny asses and stand up for us for once and for all.

My very point to Lawyers for Britain a few days ago when it became obvious that an extension would be sought..There is clear Constitutional law from the Gina Miller case and another point I raised was that Gordon Brown signed us up to the Treaty of Lisbon via Royal prerogative which is now clearly unconstitutional but looking for a retrospective judgement would be tricky

If the government can take down facebook Twitter and other platforms that exposes them and turn the police on the people that exposed them. What chance will a letter do. They probably got high court judges that are corrupt as well. I do really wish that this works as i have given up on all hope of trying to to get what we all voted for. Im so bloody angry at this government and the Queen for not stepping in and closing down parliament as it is not fit for purpose now. All these MPs and the PM should be taken to court for treason.       Our membership of the EU is unlawful as it violates the rights of the individual under the terms of the Bill of Rights 1689. That Act of Parliament requires the Monarch to defend the rights of the individual, and prohibits him/her from handing over the government of this country to any foreign power.
      Under the Magna Carta the Monarch is obliged to defend the rights of the individual and to obey the law him/herself.
      When the Monarch breaks the law, we as subjects also have an obligation under Magna Carta to so harass him/her (but without physical harm) to bring him/her back into compliance with it.
      By voting in the 2016 referendum We gave an instruction to Parliament to withdraw the United Kingdom from the European Union. Neither it nor the Monarch has any power to break the law by ignoring, or delaying, or obfuscating, or evading that instruction.
      I am reminded of the quote by Sir Arthur “Bomber” Harris speaking about the German air offensive against the UK in WW2
      “They…. have sown the wind, now they will reap the whirl wind.”
      We have the power and the duty to defend our rights under the British Constitution.
      So, let’s just get on with it!

  84. For all those who have asked various questions above, relating to Robin Tilbrook's campaign to bring a case against the Government, please read the below that I have actively been posting around FB and MeWe today.

    Before I get into the guts of what you can do to support, I would like to clarify the numbers in a few posts above.

    As the English Democrats Party, of which Mr Tilbrook is the Chairman of, as well as being a Solicitor - mention their demographic being English voters (15,188,406 ) for obvious reasons.

    However, as you will read below this legal challenge is and should be nationwide: essentially, if you voted for Leaving the EU, whether you reside in England, Wales, Scotland or Northern Ireland and support it, you can support via the below detailed ways.

    As you may or may not be aware, I have been an advocate for some time into looking at the possibilities to seeking legal representation, for submitting Judicial Review(s) into the current presiding UK Government and many of it's Parliamentarian's handling of the UK's Withdrawal from the European Union, that 'Truly' respects the June 23rd, 2016 Referendum on such.

    However, I cannot stress enough, that the above is incredibly time sensitive in many ways and we as a collective majority of the Nation, who voted justly and legally to Leave the European Union - which was on many occasions stated as fact by many Politicians pre and post Brexit Referendum, to mean;

    Leaving the Single Market, the Customs Union, the jurisdiction of the European Courts of Justice, the Common Agricultural Policy and the Common Fishing Policy. Ultimately delivering a clean break from the EU so Britain can take back true and just control of its laws, borders, trade and money plus much more for many years to come.

    we are all hoping that this nightmare ends suddenly in 2 weeks time due to legalities. Maybe May will turn out to be the hero in this, having prevaricated and run the clock down time and time again intentionally. In this case she would have done her duty and can point to hand on heart it wasn't her fault that we left and everyone is happy.

  103. Good on you Robin Tilbrook. I hope you get successful in court to block them from extension to the Article 50 notice, or to revoke so we would leave the EU on the 29th March.

    If you get successful, please report to the media and tell them you have successful win your case against the corrupt government from extension to the Article 50 notice or to revoke as we need people to be aware what a corrupt and criminal the government are for acting unlawful. When you have done this, we will be happy to leave the EU on the 29th March with no deal.

  105. I wish you luck, with our lawless government we have now I don't think they will like this, you're right of course but that has not stopped the remain MP's from doing anything to stop brexit.

    My view is you should never have been in the EU in the first place, under the Bill of Rights 1689 they tell us we do not have it says that no foreign power should rule over us. What does the EU do? rule over us.

    The Brexit fiasco has now got to the ridiculous and farcical stage. Millions , if not billions of pounds has been wasted on the ridiculous and invalid Article 50 which is contractually unsound.

    I have unearthed advice given to Michael Gove which appears to have been ignored. I would be grateful if you would kindly ask him why it was ignored and even better, ask Mrs May on Wednesday.
    MICHAEL GOVE SOUGHT HER ADVICE………WHY WAS IT IGNORED?

    Professor Ingrid Detter de Frankopan is a distinguished international jurist and Lindhagen Professor Emeritus having held the Chair of International Law at Stockholm University. She advises on aspects of public and private international law, on the law of the EU, including the right to leave the organization. She is also an expert on French, German and Italian law as well as on the law of all the Scandinavian countries, and on the Law of International Organisations and on the Law of War.

    She is a Former Fellow of St. Antony’s College and Lady Margaret Hall at Oxford University. She was Adviser to Pope St. John Paul II between 1984 and 2005 and has been Adviser to various Governments during her long and distinguished career in inter-State conflict resolution.

    Ingrid Detter was educated at Lyceum, Stockholm, Sweden & Mon Fertile, Morges, Switzerland; and at the Universities of Stockholm, Oxford, Paris and Turin.

    Recently she has attended the Human Rights Sessions on the Convention on Discrimination of Women at the United Nations, New York, and advised the Lord Chancellor Michael Gove on legal aspects of Brexit.

    Despite my best attempts, says professor of international law Ingrid Detter de Frankopan, everyone has been deaf to the painstakingly simple course for the United Kingdom to take: don’t trigger Article 50 at all.
    Second rate lawyers are misleading everyone in the country by insisting that, in order to leave the European Union it is essential to “trigger” Article 50 in its entirety. This line has been swallowed whole by the government, the media, and commentators. It is, however, absolute nonsense. Under international law and under Article 50 (1) itself, only notice to leave is necessary.

    I said this it at the Referendum and ever since and I would have done it. Art. 50 is actually contractually invalid and unlawful as it represents a lack of goodwill, unfair contract terms and a willingness not to deliver a contract. I am sure the legal beagles in the Commons know this but are simply conning us as usual. We could have been out of the EU a month after the Referendum working on WTO rules under International GATT procedures where there would be no tariffs for at least three years. The difference to the Withdrawal Agreement would have been that we were out and free to negotiate outside the EU so they would have no political leverage over us. We have been let down badly by stupid politicians and crooked civil servants.....................................its as simple as that!🇬🇧

  117. There were 17.4 millions not over 15 millions voters who voted to leave the EU. You should corrected the paragraph with this information as it is very, very important. And when it will be lodged in? There are jus 4 days to leave the EU?

  118. I think the 15 million voters he refers to is the English ones as he is representing them. English law is different from Scottish law, not sure about the other devolved parties, and I think this is why he is representing English voters. I may be wrong but that was my take on it

  126. Isn't there a preliminary point which has been missed?Article 50 is an international treaty provision about a state withdrawing. It contemplated the negotiations on all matters withdrawal and future relationship within 2 years of a Notice being served. But immediately the EU sought to dictate a change of sequencing putting talks about the future beyond the 2 year period. What power was there to do that? It implicitly varied the treaty and extended time for negotiations about the future relationship fundamentally contrary to what the Article provided for. What power did May have to agree that variation? It wasn't authorised by statute nor were there any prerogative powers. To then 2 years down the line be seeking to further extend the time and therefore further vary the treaty seems to be an undermining rather than applying the entire provision. The validity of that is a matter of law.
